Exchange Visitors (J-1)

The J-1 Exchange Visitor is an unusual visa type: it can be used for a variety of purposes, from nannies and summer camp counselors to professors and researchers. I use the visa most commonly as a temporary replacement for the H-1B. It has serious disadvantages in comparison to the H-!B:

  • It can only used for 18 months -- the H-1B can be extended for an extended period
  • It requires nonimmigrant intent -- the H-1B allows dual intent
  • It should be obtained at the consulate -- the H-1B can be obtained by change of status within the US

However, it has some advantages, too:

  • When there are no more H-1B visas available, the J-1 is still available
  • You can qualify with less education and experience than required for the H-1B
  • The filing fees are much lower than for H-1B

This visa can be a real life-saver in certain situations, though it can also cause serious problems if use inappropriately.
